1. Acceptance
These Terms of Service are an agreement between you and Doctale ("Doctale," "we," "us," or "our"). By accessing the doctale website, mobile apps, or related services, you agree to these Terms and our Privacy Policy.
If you use doctale on behalf of another person, you confirm that you have permission to do so and that you will use the service in that person's best interests and in compliance with applicable law.
2. The service
doctale helps users record or upload medical-visit audio and turn it into summaries, medications, appointments, reminders, and next steps. The service may also help users share visit information with family members, caregivers, and other people they invite.
You must be at least 13 years old to use doctale. If you are under the age of majority where you live, you may use doctale only with permission from a parent or legal guardian.
3. Not medical advice
doctale is not a medical provider, healthcare professional, emergency service, or substitute for clinical judgment. The service does not diagnose conditions, prescribe treatment, or create a doctor-patient relationship.
Always confirm important medical information with a qualified healthcare professional. For emergencies or urgent symptoms, contact local emergency services immediately.
4. Recording consent
You are responsible for following all laws and rules that apply to recording conversations, telehealth visits, in-person appointments, healthcare providers, and other people. Some places require consent from everyone being recorded.
Before recording, you should tell participants that you are using doctale and obtain any consent required by law, clinic rules, telehealth platform rules, or professional obligations.
5. User content and AI output
You keep your rights in the audio, notes, transcripts, summaries, and other content you provide to doctale. You give us permission to process that content only as needed to provide, secure, support, and improve the service as described in these Terms and our Privacy Policy.
AI-generated summaries, medication lists, appointments, and next steps may be incomplete, inaccurate, or misunderstood. You are responsible for reviewing output carefully and checking it against instructions from your healthcare professional.
We require our AI and transcription processors not to train their general-purpose models on your health content.
6. Care-circle sharing
doctale lets you invite family members, caregivers, and others into a care circle. Depending on available permissions, those people may view, edit, comment on, and further share content.
Only invite people you trust. Once you share information with another person, they may keep copies, discuss it, or share it outside doctale. We are not responsible for actions taken by people you invite or by people who receive content from them.
7. Accounts and security
You are responsible for keeping your account, device, and login information secure. Tell us promptly at support@doctale.ai if you believe your account or device has been compromised.
You agree to provide accurate information and to update it when needed. We may suspend or limit access if we believe the service is being misused, your account is insecure, or continued access may create legal, security, or safety risk.
8. Subscriptions and app-store payments
doctale is free for patients for core visit recording, summaries, medications, and next steps. Paid subscriptions may be offered when you add more people to a care circle or use family-management features.
Subscriptions are managed by Apple App Store or Google Play. Billing, renewal, cancellation, refund eligibility, tax, and payment processing are handled by the app store where you subscribed and are subject to that store's terms.
Prices and features may change, but changes will not reduce rights you already paid for during the current subscription period unless required by law or app-store rules.
9. Acceptable use
You agree not to:
- Use doctale unlawfully or to violate another person's privacy, recording rights, intellectual property rights, or healthcare confidentiality obligations.
- Upload content you do not have permission to process or share.
- Use doctale for emergencies, diagnosis, treatment decisions, or medication changes without professional confirmation.
- Interfere with, reverse engineer, overload, scrape, or attempt to bypass security or access controls.
- Use doctale to create harmful, deceptive, abusive, discriminatory, or illegal content.
10. Third-party services
doctale relies on third-party services for infrastructure, transcription, AI processing, anonymous analytics, app distribution, and subscriptions. These include Amazon Web Services, Soniox, OpenAI, Google Gemini, PostHog, Apple, and Google.
Your use of Apple App Store, Google Play, device permissions, telehealth platforms, email, messaging apps, or other third-party services is subject to those services' own terms and privacy policies.
11. Doctale ownership
Doctale and its licensors own the service, software, design, trademarks, and related technology. These Terms do not give you ownership of doctale or permission to use our brand except as needed to identify the service.
If you send feedback or suggestions, you allow us to use them without restriction or compensation.
12. Suspension and termination
You may stop using doctale at any time. We may suspend or terminate access if you violate these Terms, create risk for others, fail to pay for a paid feature, or use the service in a way that may harm doctale, users, or third parties.
13. Disclaimers and limitation of liability
doctale is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, error-free, medically accurate, or suitable for your specific healthcare needs.
To the maximum extent permitted by law, Doctale will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, medical decisions, treatment outcomes, or harm caused by reliance on AI output.
Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
14. Your responsibility
You agree to be responsible for claims, losses, liabilities, damages, costs, and expenses arising from your misuse of doctale, your violation of these Terms, your unlawful recording or sharing, or content you provide or direct us to process.
15. Governing law
These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules. Courts located in Hong Kong will have non-exclusive jurisdiction, except where applicable consumer law gives you the right to bring claims elsewhere.
16. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, or another reasonable method. Continued use of doctale after updated Terms become effective means you accept the updated Terms.
